Fireworks Ordinance

            SECTION 2. Fireworks Use.  Section 41.12 is hereby amended to read as follows:

41.12 FIREWORKS USE

  1. Definition. (shall remain the same) The term “fireworks” includes any explosive composition, or combination of explosive
     substances, or articles prepared for the purpose of producing a visible or audible effect by combustion, explosion, deflagration or
    detonation, and specifically includes blank cartridges, firecrackers, torpedoes, skyrockets, roman candles, or other fireworks of like construction and any firework containing any explosive or flammable compound, or other device containing any explosive substance.
  2. Regulations. A person shall not use or explode consumer fireworks on days other than July 3rd, 4th, and 5th and Fridays, Saturdays and Sundays from June 1st to July 8th and only during the hours of 12:00 pm (noon) to 10:00 pm on those specified days from June 1st to the Saturday after 4th of July; December 30th of each year from the hours of 4:00 pm to 10:00 pm; and December 31st of each year starting at 4:00 pm through January 1st ending at 12:30 am.

A person shall not use, explode or discharge Consumer fireworks on real property other than that person’s real property or on the real property of a person who has consented to the use of consumer firework on that property.  A person shall not use, explode or
 discharge Consumer fireworks on publicly owned property included but not limited to City streets and parks, except as specifically
authorized by permit issued pursuant to the City of Slater Code.  A person that chooses to use, explode or discharge Consumer fireworks on their property shall have responsibility to clean up all debris created by the fireworks.   

The City may, upon application in writing, grant a permit for the display of fireworks by a City agency, fair associations, amusement parks and other organizations or groups of individuals approved by City authorities when such fireworks display will be handled by a competent, trained, and insured operator.  No permit shall be granted hereunder unless the operator or  sponsoring organization has filed proof of such training and insurance.  

Any person in violation of this Ordinance shall be fined $150.00 per incident. 

SECTION 3. Sale of Fireworks.  Section 41.13 is hereby created to read as follows:

    41.13 SALE OF FIREWORKS.

  1. No person, retailer, consumer group or otherwise shall sell or display for sale any fireworks without possessing a permit from the State Fire Marshall and complying with all State, Federal, and local laws
  2. Temporary sale of display for sale of fireworks is allowed through the use of temporary sale structures.
  3. Temporary Sale Structures shall only be allowed and erected during the permitted dates for sales according to State Law.
  4. Temporary sale structure locations shall have hard surface paved parking.
  5. All fireworks shall be stored in a secured and locked location during non-sale time pursuant State Law.
  6. Temporary sale structure owners, if not the property owner, shall have written consent by the current property owner at the location where the structure is located.
  7. Proof of State Licensing and compliance with state regulations shall be submitted to the City prior to sale of any items.
